Instructions

 Please use the following instructions to properly complete the BER and accompanying documents, as required under Education Code § 56521.1, regarding emergency interventions.

  1. BER (Behavior Emergency Report) Form is required to be completed within 24 hours whenever an emergency intervention (physical restraint) is employed.
    1. Review the BER
    2. Determine the necessity for a FBA  (Functional Behavior Assessment)
    3. Determine the necessity for an interim BIP (Behavior Intervention Plan) 
    4. If it is determined that neither an FBA and/or an interim BIP will not be completed the IEP will document the reasons for that decision
  2. The Holder of Educational Rights and the caregiver (parent/guardian or other) shall be notified within 24 hours if an emergency intervention is used or serious property damage occurs.
  3. If a BER is written regarding an individual with exceptional needs who does not have a behavioral intervention plan, the designated administrator shall, within two school days, schedule an IEP(Individualized Education Program) team meeting to:

If a BER is written regarding an individual with exceptional needs who does have a BIP, or an incident involving a previously unseen serious behavior problem, or where a previously designed intervention is ineffective, the incident shall be referred to the IEP team to review and determine if there is a need to modify/revise the current BIP.
  5. Send  the following completed forms to site administrator and District Office-Special Educationwithin four school days:
    1. BER Checklist
    2. BER 
    3. BER Postvention
  6. Copies of the BERshall be placed in student files as follows:
    1. General Education Students:  Copy of BER to CUM File
    2. Special Education Students:   Copy of BER to Permanent Student Record and in site based “green file”.
